Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FiduciarySignal (the “Service”), a service operated by D & F Research, LLC, a Florida limited liability company (“we,” “us,” or the “Company”). By using the Service you agree to these Terms.

1. The Service

FiduciarySignal displays public Form 5500 ERISA filings published by the U.S. Department of Labor, computes peer-group benchmarks, and generates summary reports. The Service is provided for informational and professional research purposes.

1A. Pricing, subscriptions, and charges

The Service offers paid subscription plans and pay-as-you-go charges. New accounts may begin with a time-limited free trial; when the trial ends, continued access to paid features requires a paid subscription. The current plans, prices, and trial length are shown at checkout and on our pricing pages, which control over any figures stated elsewhere.

  • Subscriptions renew automatically each billing period (monthly or annual) until canceled. You authorize us, through our payment processor, to charge your payment method the applicable recurring fee.
  • Pay-as-you-go items (for example, individually revealed data “signals”) are charged to your payment method when the item is delivered. You are shown the price before you request a charged item.
  • Cancellation. You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current paid period; you keep access until then and are not charged for the following period. Fees already paid are non-refundable except where required by law.
  • Price changes. We will give notice of any change to recurring prices before it takes effect; continued use after it takes effect constitutes acceptance.
Not financial, legal, or tax advice. Information shown by the Service is derived from public regulatory filings and should not be relied on as individualized investment, retirement, fiduciary, tax, or legal advice. Always verify figures against the underlying Form 5500 filing and consult a qualified professional before making decisions.

2. Eligibility and accounts

  • You must be at least 18 years old to create an account.
  • Accounts are personal and may not be shared.
  • You are responsible for maintaining the security of the email address linked to your account.

3. Acceptable use

You agree not to:

  • Scrape, mirror, or systematically download the Service's compiled benchmarks or report content.
  • Attempt to bypass authentication, rate limits, or other security controls.
  • Use the Service to harass, defame, or solicit individuals identified in filings.
  • Re-publish generated reports in a way that implies they are produced by the U.S. Department of Labor or any government agency.
  • Use the Service to violate any applicable law or third-party right.

4. Data sources and accuracy

Source data is downloaded from the DOL EFAST2 public datasets. We make reasonable efforts to import and present this data accurately but make no warranty of completeness, timeliness, or correctness. Plan sponsors sometimes file amendments or corrections after their initial submission. Always verify against the original filing before relying on a figure for a material decision.

5. Intellectual property

The underlying Form 5500 data is in the public domain. The Service's compiled benchmarks, peer-group methodology, report templates, charts, software, and visual design are owned by D & F Research, LLC and protected by copyright and other laws. You may use generated reports for your own internal and client-facing professional work; you may not resell the Service or its compiled outputs as a standalone product.

6. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the maximum extent permitted by law, D & F Research, LLC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service. Total aggregate liability for any claim arising out of or relating to the Service shall not exceed one hundred U.S. dollars (US$100).

8. Termination

You may stop using the Service at any time and request account deletion by emailing support@fiduciarysignal.com. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to other users or the Service itself.

9. Changes to the Terms

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Continued use of the Service after a change indicates acceptance.

10. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Florida.
